Good points. I think it is often used in situations where it shouldn't be used because of doubts about a convicted criminal's guilt. Of course, no jury will convict someone and sentence them to death without being completely sure, but we've all learned from society that people can think they are right and be totally wrong about almost anything. When someone's life is at stake, serious things are at hand.
